By entering this site and/or placing an order, you acknowledge you are of legal age (18 years or older). We comply with all current Illinois tobacco taxes. Outside the state of Illinois, taxes and tax compliance are the sole responsibility of the dealer or individual ordering these goods.

Shipping Policy

All orders are shipped via UPS unless prior arrangements have been made. We offer several shipping options: Ground, 3-Day Delivery, 2-Day Delivery, Next Day Air, and International Service. Prices vary depending on the weight of the package and the location of delivery. Orders placed before 3 pm central time will be shipped same day subject to product availability. Please note some orders may take 3 – 5 business days for processing and shipment.

  • Illinois residents will have state sales and tobacco taxes added to their final cost at checkout
  • International Customers are responsible for all Duty and Applied International Taxes on any online purchase. In some cases Duty and Taxes may be charged separately from your purchase using the original method of payment.

Return Policy

Your satisfaction is our number one priority. If you are not satisfied with your purchase, you may return the item within 5 days of receipt of your order for an exchange or store credit less shipping if applicable.

Returns can take up to 10 business days from receiving a return to process. Before returning the item, please contact us at (773) 242-8262 and let us know what item you are returning and why. A Return Authorization Number (RAN) will be issued. It is important that you make note of this number to include with your return.

How the return policy works:

  • All tobacco products must be unopened in the original packaging and cellophane. The seal must be unbroken on any merchandise purchased. This includes boxes of cigars purchased or samplers, packs and non-cigar tobacco.
  • Returns must be in new, unopened condition to receive full credit. This includes having cigars in their cellophane wrappers.
  • Please keep the original packaging and any accessories to return with the item and do not return any cut or smoked cigars, as this may affect your refund.
  • Lighters, Pipes and other merchandise must be unused at the time of return. We will not accept any lighters that have been filled or used prior to being returned.
  • If you fail to return merchandise within the given time frame or without an RAN, we may deny credit or issue a 15% re-stocking fee.
  • A re-stoking fee of up to 15%  will be applied to all online orders that are refunded.

We are committed to protecting your data and privacy. This policy (together with our policies above  sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it.

SECTION 1 – WHAT DO WE DO WITH YOUR INFORMATION?

When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.

When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.

Email marketing (if applicable): With your permission, we may send you emails about our store, new products and other updates.

How do you get my consent?

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

How do I withdraw my consent?

SECTION 3 – DISCLOSURE

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

SECTION 4 – CREDIT CARD INFORMATION

If you choose a direct payment gateway to complete your purchase, PayPal stores your credit card data, your credit card details are not stored on this server. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS).

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

SECTION 4a – CREDIT CARD FRAUD PREVENTION

We take credit card safety very seriously. To help protect against unauthorized purchases we require that all personal information including name, street address, apt number (if applicable), city, state and zip code used as billing address match the information on file with the bank that issued your credit card.

We work with the Fruad Division of our payment processor to identify potential threats and decline these transactions.

If your transaction is flagged for fraud you will recieve an email from a member of the Blue Havana Management Team. You will be asked to send a copy of a photo ID along with the credit card what was used for verification purposes. If you do not submit this information within 24 hours your transaction will be cancelled and refunded. Refunds can take up to 30 days to process through our payment processors fraud department.

SECTION 5 – THIRD-PARTY SERVICES

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Policies.

SECTION 6 – SECURITY

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption.  Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

SECTION 7 – AGE OF CONSENT

By using this site, you represent that you are at least the age of 21 or older depending on the guidelines established for legal tobacco purchases set by your state or province of residence.

SECTION 8 – CHANGES TO THIS PRIVACY POLICY

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.

If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.
